How to Get a Veterans Disability Settlement

Whether you are considering divorce or you are currently engaged in a divorce, there are many different aspects of your divorce that can impact your ability to get a settlement for veterans disability. This article will outline the benefits you could receive as a VA member and how to claim these benefits.

Dependency and indemnity Compensation (DIC)

DIC is a tax free money-based benefit that is paid to the survivors of spouses, children, Veterans Disability Settlement parents and other family members of veterans who die due to a service-related disability. VA provides this benefit in different ways. The relationship with the veteran will determine the process of claiming.

To apply for DIC the claim must be filed using VA Form 21-534. The form is available at your local County Veterans Service Office. A VA-accredited claims agent will assist you in filing the claim successfully.

The amount of DIC due to a veteran is contingent on the length of service as well as the disability rating. A veteran who has 100% disability will receive $2400 per month in DIC payments. A person who has a 10% disability will be paid $112 per month. Additional amounts are offered to spouses of disabled survivors and dependent parents and to those who require regular aid in addition to the basic DIC rates. These amounts are stated in 38 CFR SS. 3.351.

The VA provides a variety of services to veterans and their families, such as the guarantee of a home loan health care, as well as other benefits. It also offers burial benefits, work-study employment and counseling for veterans going through bereavement. The people who qualify for DIC may receive tens of thousands of dollars in tax-free payments.

A spouse of a veteran must been married for a minimum of eight years to qualify for a DIC. If the surviving spouse remarries before the death of the veteran, she or he loses eligibility for DIC.

In addition to the DIC survivorship parents or other family members of the deceased veteran may be eligible for disability compensation under other forms. The VA may also offer an income-based benefit. These benefits could include Education Assistance for Dependents and Survivors.

Housebound benefits and Aid & Attendance

Numerous financial aid programs are available to assist veterans disability claim pay for the cost of nursing and assisted living homes. The VA's Aid and Attendance Program and Housebound Benefits are two of these programs. These programs are designed to help veterans who are housebound or severely disabled.

Two pension programs supplementary to the pension are provided by the VA and include the Special Monthly Pension with Aid and Attendance (SMPA) and the Housebound Benefits (HB). Both programs aim to provide veterans with an additional monthly income. These programs are only available to veterans who have served at least 90 consecutive hours in active service during a wartime.

Aid and Attendance as well as housebound benefit is a tax-free financial benefit paid to surviving spouses and children of service members of deceased veterans disability compensation, as well as the parents of dependent military members. The Aid and Attendance program could be the only source of funds for veterans who aren't able to perform everyday tasks. This includes bathing, dressing, grooming and reminders for medication. Survivors and military personnel can also qualify for DIC an illegitimate tax-free payment that covers aid and attendance expenses. These expenses could include prescription medication as well as home health care and transportation to medical facilities.

Benefits of the Thrift Savings Plan

If you are going through a divorce during a divorce, the Thrift Savings Plan (TSP) could be a source of confusion. This retirement plan that is sponsored by the federal government provides federal employees tax-deferred benefits.

You can transfer your current TSP account to a qualifying account if separated from military service. You can either transfer the money to your current or former spouse, or you can keep it in the TSP. You can also transfer your TSP funds into the G fund and it is a certain method of keeping your money active.

The TSP includes a number of other features too. You can borrow money for residential and general purposes. The repayment term is generally one to fifteen years, depending on the kind of loan. You can also withdraw tax-free from the account.

The TSP can be an asset in a divorce. A valid court order is required to garnish your former spouse's TSP account.

The IRS limits you on the amount you can contribute to your TSP. After-tax contributions can be up to $20,000. If you have an active duty TSP loan, you can repay it upon separation.

It doesn't matter whether you are going through a divorce, or just trying to save for retirement.
